A question about the C&D and video walkthrough.
« on: June 11, 2009, 09:54:36 pm »
The C&D order first insisted that there be no leaks permitted. Several versions have already leaked, which I can understand is beyond your control, but as each new video is uploaded to the main page, I can't help but question something within your C&D requirement.

Quote
“We hereby request and demand that you immediately remove, take down, delete and destroy all work on CT:CE, as well as all other Square-Enix related ROM hacks currently on your sites.”

As you are demanding that all alpha version owners delete the game from their computers immediately, why are you failing to comply with your own C&D by not deleting the files from your own computers in order to upload a video walkthrough for the month? Are you picking and choosing which parts of the C&D to comply with, or did SE give permission to not delete the files from your computers until you had finished a video walkthrough?

It seems like the cease and desist has been violated more than not. Is it less illegal for a 25% version to be leaked than a 98%? Or is it less illegal for the copies to be undeleted on your machines, but not everyone elses?

The video walkthrough was already recorded before the C&D, they aren't going against the C&D as far as I know.

I don't consider a video walk through to be work on CT:CE....All copies of CT:CE have been destroyed, as well as "ROM hacks".  I also have several pictures of CT:CE which I consider to be fine.

This coupled with the fact that there were several video trailers, and videos of the Demos which the C&D did not mention, as well as the fact that it is a totally different medium makes me think that videos are ok.  Not to mention the fact that YouTube is pretty infamous for taking down videos when copyright owners ask.

Don't confuse our compliance with the C&D as us not caring about the project. We are going to let Crimson Echoes story be known were just not going to risk 150,000 dollars to do it.

EDIT: Also Acacia is speaking the truth up these videos were planned to be released with the game as a "video walkthrough". We planned this when we had a ton of people constantly asking "where's dalton's dungeon" after the demo was released.

At 98% completion, they decided to record a video walkthrough rather than knock out the two last % and record it after? Right before they happened to receive the C&D? That's.. convenient, I suppose. And plausible enough for SE to be unable to do anything about it.

Well...considering we wanted to release the walkthrough with the game we had to do it before 100%.....

Also I guess technically this is like....95%.... You'll notice several times in the commentary I say something like "Ugh I thought we fixed that"....well truthfully we probably had actually fixed it but not while FW was making the walkthrough.

As I've said before, if I could re-record some parts I totally would have. Then I wouldn't look inattentive half the time when I'm aimlessly searching through menus and getting my arse kicked at the Choras casino.  8)

The way I felt about it at the time, if I could get a pretty much bug-free runthrough down toward the end of April/early May before finals, I'd go back after finals were over and re-record certain things (the unpaletted overworld Neo Epoch being my primary concern).

Gah, had I known the CE team was going to get a C&D, I would have pushed to figure out the Neo Epoch palette instead of sidetracking myself with odd projects like this, which I used as a test case for my audio re-treatment of the Emerald Dream chapters. I am known for multitasking, but I am also known for quirkiness.

You make it sound like "they" are one person. I'm not 100% sure, but perhaps FW was recording his play-through while other members were working on completing the project. And like the others have mentioned, the videos don't conflict with the C&D (thankfully).

It's a walkthrough. The remaining 2% wouldn't have effected its ability to be helpful to people playing through a 100% version. Always good to have an official walkthrough beforehand rather than release it first and then make it because people would have just made their own...and of course, in light of the C&D, it turned out to be a good preemptive measure to such...

Convenient would have been keeping things even more underwraps it seems...or else spreading it around prior to 100%...but who can tell now what would have been? It isn't.

It was convenient but not in the way  you think. If this is the only reason you have come here...to slander peoples good names with "subtle" accusations then please turn around now....then again it's not my place to say just a thing, I just dislike rude people.

Also I noticed it says all "work on" since the videos are not working on CE and are not ROMs I see no reason why the videos are a problem.

Also Walkthroughs are made near the end of production, but before the game is complete. Sometimes you'll see screenshots that are not in the game anymore because of this. It's a commen practice so the walkthough can be released along with the game so they can make more money. (Hopeing people will buy the guide with the game so when they get stuck they won't have to wait till they get to the store again or so they can know where the sidequests are so they don't miss one of those tricky only a short chance to do it ones.)
