Title: Attention
Post by: ZeaLitY on May 11, 2009, 10:44:05 pm
For any beta testers, friends of beta testers, and so on, leak = ban, and the Compendium can't really protect you if SE subpoenas your name or decides to prosecute. We will document to the best of our ability who's thinking about leaking. Even a fake leak = ban. You were asked to comply with the C&D and warned.

This must mean the hack still exists, then. >_>

Of course, I know you really can't publicly announce that if it does.

Well it's supposed to be deleted.  But there's no way to know for sure, seeing as how a select handful have the beta's.
Title: Re: Attention

To reiterate:

CE was not even a ROM. It was a standalone modification. The user needed to have a backup of Chrono Trigger SNES on their hard drive and apply the mod to that backup. Any file that says ".smc" -- the extension for SNES backups -- is patently false on its face.

Post by: ZeaLitY on May 11, 2009, 10:48:54 pm
CE was fine-tuned by a few beta testers. While I e-mailed them two days ago and asked that they comply, I have no way of physically forcing them to.

ZeaLitY and agent12, to the best of their abilities, have deleted all copies and ways to get copies of the hack.

Of course, I know you really can't publicly announce that if it does.

It's not a ROM, as was explained. Anyhow, all known copies of the game were destroyed. Unfortunately, because Crimson Echoes had already been in beta testing when the CE team got the C&D letter, numerous people had their own copy of the nearly-completed game. ZeaLitY has instructed beta testers to destroy their copies, but of course we have no way of knowing for sure if they have done so. What we can be sure of, like ZeaLitY said, is that anybody who leaks this thing will be banned, and, more than that, will be identified to Square Enix, and then they can mull over the SE's lawsuit threat.

If the people who actually spent years of their own time and energy making this game are willing to comply with SE's demand--as shitty, ungrateful, wrong-headed, mean-spirited, and money-grubbing as that demand may be--then the rest of us should strive to be at least as generous and mature, and accept that the corporate beast has spoken and Crimson Echoes is broken.

We are definately talking about the same post.  And it doesn't matter if you are him or not to me since I never had much of an issue.  I just worry about continuous, small, one sentence posts - as if the forum were a chat room or AIM.   You aren't at the felony point with that yet, so don't think I'm on your back or anything - its all good.

Your epic post has some really good ideas,  I hope to see more of that in other "chrono mechanics" threads.

Chill pal, no one's really worried that you're Shadow--just learn from his mistakes: post well, be literate, be an intellectual, contribute to the topic at hand. And with that, we're done talking about you.

Zeality, or anyone who could provide a response, what is next on the course of action for you guys? I know Agent12 tried calling, but do you guys have some kind of plan for the future? You don't have reveal it, I'm just looking for a yes or no.

You see, I've been saying the whole "is Serge SDD?" thing for a while, but I'm not so sure that it is...I think it's just a coincidence that someone with similar bad posting etiquette appeared after our last one *ahem* left. "n00bs are like RPG monsters..." & all that.

Anyways, as for the topic at hand, I'm glad it's been addressed finally. All of the stupid people saying, "Oh, I bet this will be leaked eventually because the beta testers have copies. *DERP DERP*" are stupid. No one that could have had a copy still stupidly has one on their computers. No one is willing to risk not only their own information getting out, but everyone else's because they (SE/lawyers/whatever) will have the right, if a leak were to ever happen, to request all or any of the admins IPs.

While it's lame that things have gone down this way, it's also just a game to everyone not suing someone else and not worth the money or even possible court time...Time to move on.

No, that much would be perfectly legitimate. Squre Enix would still not approve, but they pick their battles, and they wouldn't battle that. It's up to the Crimson Echoes team, of course, to decide what to do, but my hunch is that I think you can look forward to learning all about the game's story, even if you won't be able to play the game itself.

One could argue that fanfiction is not protected under fair use, since it's not parody or critical commentary.

One could rightly argue that it was a straight out derivative work, and therefore a copyright infringement if not authorized.

And it's not like it costs SE a lot of money to send out Cease and Desist letters.

Fair warning, I suppose.

I wish but you would miss out on somethings like Frog's other options that was shown on that demo on destructoid unless they have one of those pick & choose adventure style fanfics. I hope they can make this into a Wiiware game if a rom patch isn't possible when it's all said and done. It can be like that sequel to FF IV that they're putting out.

Eh, I guarantee one or two of the beta testers probably kept their copy. Even with the threat of lawsuit over their heads, I doubt someone who's been working on something for so long is just going to destroy it just like that. Look at how many people keep kiddy porn on their hard drives, which you can go down a whole hell of a lot harder for than for a simple rom hack.

Doesn't mean we'll ever see a leak of CE, though. Maybe in ten years when the heat's died down, we've all got white beards and two or three marbles rolling around in our heads, then one of them might let it out.

I'm sorry to anybody who has put their time and effort into a harmless piece of work called Crismon Echoes which I am sure you even have neglected your other favorite stuff.

Therefore you wind up  spanked by a company called Square who needs to learn their own priorites.  :(

You said it RySenkari!  Thank you.

Anybody who does hide a copy of CE should get praised for standing up to a goverment and big companies that love to strip your freedom.

Tis better to go to jail then to live a 'half-life' bowing to a corrupted government secretly wondering why you live.

I sound like a complete jerk now and also an asshole but one day you'll all thank me for that quote cause someday a member here will be "sued" for playing Chrono Trigger's theme on their 'Yamaha' keyboard when someone walking by their house hears it and reports to the police for copyright infrigment when the goverment goes  on a major crack-down on 'piracy'.  (including overseas)

By that time search warrents will likely be non existent and I'll be surprised if they still do exist.

Anybody who takes this as a big boo-hoo scare message needs a mental check on themselves also as I don't intend to scare anybody.

The problem is that no one here is prepared to throw their life away over a game (for good reason).

It's just a shame that Square is taking such a hardass stand on this, to the point that even if it's clear that Zeality and the other CE creators are totally blameless in any leak, that Square is ready to bring the hammer down. It's obvious that this hardass stance is what will probably end up preventing the game from being leaked at all.

I'm reminded of last night's episode of 24 in which Jack Bauer ran his ass off desperately trying to throw the biological weapon in the containment chamber. He got it in there just in time. Square is the Jack Bauer of this situation and it looks like they got the weapon in the chamber just in time. Only in this case we were all rooting for Jack Bauer/Square to lose.

It's funny... I want to play this game so bad, but I don't want to see the people who worked so hard on it get sued.

Square knew what they were doing, ensuring that anyone saying "I hope there's a leak" is basically saying "I hope Zeality and all those other guys get sued". I'm amazed they were able to put the clamps on so tight just three weeks from release.

Trademark law basically says that if they don't defend their trademarks, they lose them (due to them becoming diluted in the public mind).  So I understand where they're coming from.

Why they didn't just talk to the people behind this (and more importantly, Chrono Resurrection) and offer up a small development support team to release a high quality product for a tenth of the cost of a from-scratch game but for nearly all the profit (they could pay the actual developers a pittance since they basically have no choice but to accept), I have no fucking clue.

Mostly because they're a Japanese company, I suspect - "better to ask forgiveness than get permission" is not that popular of a principle over there.

As was mentioned, they are a Japanese company. Haggling with the US branch of their legal department isn't likely to get much personal attention from the folks actually in charge of the series. The best bet for an "official" license on the game is if they brand it an AU "gaiden" game. I doubt Kato would just up and accept it as a canon sequal though.
